When Can Illinois Suspend or Revoke Your Driver's License?
Illinois law frequently uses the threat of driver's license suspension or revocation to encourage its residents to obey the laws. Some of the reasons your driver's license may be suspended or revoked include:
- After a DUI arrest: Suspension occurs automatically on the 46th day after a DUI arrest if the sobriety test showed a blood alcohol level (BAL) of 0.08 percent or higher or if the driver refused to take the test.
- After a DUI conviction: After a DUI conviction, your driver's license will be revoked for a minimum of 12 months on a first offense and 5 years on a second offense. If you are a minor under 21 convicted of a DUI, your driver's license will be revoked for at least 2 years after a first offense.
- Zero tolerance for minors: License suspension will happen to any person under 21 who is arrested for any moving violation and either refuses to take a sobriety test or shows a BAL higher than 0.0 percent.
- Failing to pay traffic tickets: If you fail to pay a traffic ticket from Illinois or any other state, your driver's license may be suspended until you pay the ticket and an administrative fee to have your license reinstated.
- Failing to pay parking tickets: If you fail to pay 10 or more parking tickets, you driver's license may be suspended until you pay the tickets and an administrative fee.
- Nonpayment of child-support: Suspension of driving privileges is one of the possible penalties for failing to pay court-ordered child support.
- Tollway violations: If you evade tollways or do not pay the toll and then refuse to pay the fines, your license may be suspended after 5 occurrences.
